1. Agreement to Terms
These Terms of Use (“Terms”) govern your access to and use of Juju Baby Tracker (“the App”), operated by Jason Phung (“we,” “us,” or “our”). By using the App, you agree to be bound by these Terms. If you do not agree, you may not use the App.
2. Description of the App
Juju Baby Tracker is a collaborative baby activity tracking application that allows caregivers to log and view baby-related information such as feedings, diapers, sleep, and other activities.
The App is intended for informational purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment.
3. User Accounts
3.1 Registration
To use certain features of the App, you must create an account using an email address, password, and display name. You agree to provide accurate and up-to-date information.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Promptly notifying us if you suspect unauthorized access to your account
We are not liable for any loss or damage arising from unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Interfere with or disrupt the operation or security of the App
- Attempt to access accounts or data belonging to other users without permission
- Upload or share content that is harmful, offensive, or inappropriate
- Reverse engineer, decompile, or modify the App
- Circumvent any security or access control mechanisms in the App
We may suspend or terminate your account if we believe you have violated these Terms.
5. User-Generated Data
The App allows you to input and store information, including baby details, activity logs, and photos.
You retain ownership of the data you log in the App. By using the App, you grant us a limited license to store, process, and display this data solely to operate and improve the App’s features.
You represent that you have the right to submit any data you enter into the App and that such data does not infringe on the rights of others.
6. In-App Purchases and Advertisements
6.1 Advertisements
The App uses Google AdMob to display ads. Third party advertising partners may collect device identifiers or usage data as required to serve ads, in accordance with their own privacy policies and your device settings.
6.2 One-Time Purchase to Remove Ads
You may choose to remove ads through a one-time in-app purchase. This purchase is processed by the Apple App Store and is subject to Apple’s payment terms. Once completed, the App will no longer show AdMob ads for your account.
7. Intellectual Property
The App and its content, including design, branding, logos, graphics, and text, are owned by or licensed to Jason Phung and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App except as expressly permitted by these Terms.
8. Medical Disclaimer
The App provides informational tracking only. It does not provide medical advice and is not a substitute for professional medical judgment.
You understand and agree that logged data may be incomplete, delayed, or inaccurate. Always consult a qualified healthcare professional regarding your baby’s health and care.
9. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or special damages arising out of or related to:
- Inaccurate or incomplete data in the App
- Loss of data or inability to access the App
- App downtime, bugs, or technical issues
- Any decisions or actions taken based on information in the App
- Unauthorized access to or misuse of your account
Your sole remedy for dissatisfaction with the App is to stop using it.
10. Termination
We may suspend or terminate your access to the App at any time if we reasonably believe you have violated these Terms or engaged in harmful or illegal activity.
You may stop using the App and delete your account at any time.
11. Changes to the App
We may update, modify, or discontinue features of the App at any time, with or without notice. Some updates may be required to continue using the App.
12. Privacy Policy
Your use of the App is also governed by our Privacy Policy, which explains how your information is collected, used, and protected.
13. Governing Law
These Terms are governed by the laws of the State of Massachusetts, USA, without regard to its conflict of law principles.
